It was always my understanding that it was illegal for doctors to bill Medicare patients whatever they felt like.  If a doctor doesn’t accept assignment but sees Medicare patients, that doctor can only bill excess charges which is 15% above and beyond what the Medicare allowed amount is.  If doctors still didn’t like that 15% above and beyond the allowable amount, then doctors had to refuse seeing anyone on Medicare.
