The Legal Broadcast Network will be devoting much of December 2015 to the study of issues related to social security, medicare and governmental benefits as it relates to trial lawyers and liability claims.
Jack Meligan, chairman of Settlement Professionals Inc, of Portland, OR joins Mark Wahlstrom to discuss the on going questions and misinformation around the issue of Medicare set aside accounts. MSA's, as they are commonly referred to are one of the most misunderstood and confusing liability issues for attorneys, but as this interview makes clear, these are established on an entirely voluntary basis as there is currently no law or regulation that requires them to be established. This voluntary act thus makes it essential that the trial lawyer inform their client and get an MSA firm that specializes in plaintiff solutions to work on the valuation and planning for this important part of a settlement plan.

Lets see I got hit bad a van while working on a outside ATM . I had been working for NCR for 10 years up to that point. It left me in a wheelchair. I am 90 miles up from NYC I went from 52 k to 400.00 a week . I am on 15 meds in the morning and 12 at night . I have severe nerve damage broken spine pain and a complete mental breakdown. My CNA wants to give me a settlement and a medicare set aside plan. It is way to low and its due to folks like you. The pay for my meds which if I had to pay would be 2014.00 a month .I am not going to take it . I will bleed them for every cent they have . If I live to be 90 or older they would have paid me over 1 million bucks . So I will make sure I stay healthy so if I drop dead they would jump for joy!!!
