Unauthorized Disclosures Of Therapy Notes To Medicare Plans – IN VIOLATION OF N.J.S.A. 45: 15BB-13

There are a number of advocacy groups having questions regarding the actions of behavioral healthcare providers in New Jersey violating state law N.J.S.A. 45: 15BB-13 and state regulation N.J.A.C. 13: 44G-12.4 (b)(2). Specifically, these behavioral healthcare providers on video ( ) are releasing the private conversation notes between therapist and patient (therapy notes) in response to some type of nationwide audit called "quality assurance review" that is being run by Medicare advantage plans and their 3rd party business associates in violation of said state laws. I have the following questions regarding this practice:

1. Could someone please elaborate on the actions being made by these behavioral healthcare providers releasing therapy notes taken by their LCSW therapists in contrary to N.J.S.A. 45: 15BB-13 and N.J.A.C. 13: 44G-12.4(b)(2)?

2. Could someone please provide the exact federal law citation for which these behavioral healthcare providers are releasing patients therapy notes which supersedes state law N.J.S.A. 45: 15BB-13 and state regulation N.J.A.C. 13: 44G-12.4(b)(2)?
